Legally, bourbon has to be made in the USA. Any state qualifies. Other requirements involve the grain composition, aging in new oak barrels, proof, etc. But Kentucky has nothing to do with it, except as marketing. Tennessee whiskey meets all the legal requirements of bourbon, though both Kentucky bourbon manufacturers and Tennessee whiskey manufacturers pretend they are distinct. Unlike bourbon and Kentucky, Tennessee whiskey does have to be made in Tennessee. Kentucky has a county named Bourbon. New Orleans has a Bourbon Street. Both of those, and the whiskey, are named after the French dynasty, which has nothing to do with the whiskey
