Question to the lawyers here, since Yankee stadium sits on government land does this become a first amendment issue if whoever is in charge of security decides to ban people for chanting puto?

My gut feeling is no, and that stadium security would never intervene unless attendees were using fighting words, but I am curious.

I am not a lawyer, but I don't think the first amendment protects things like yelling curse words in a public space. I feel like in this instance speech is being used to attack someone, not express anything in particular.

This is the actual text of the first amendment: Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Good idea. What better place to take a stand against this homophobic behavior than NY.
While I wont go as far as to say the chant ruins my experience at the game, it is truly offensive.
A PSA video with all the players, in all the languages spoken by our team before the game would be cool.

Bill of Rights and Constitution does not limit what individuals can do to other individuals. Only government to individual. Yankees and Securitas are not the government, or working as a contractor for the government, or providing a government service so I would say no.

True, but YS can almost definitely revoke the ticket's use from the holder. I haven't read the fine print on our tickets, but it's standard legalese with tickets to any private event (concert, sporting event, etc) to include the right of revocation for any number of reasons.

Yes. They can limit speech and revoke your ticket for the speech you use.

This is not government action. The Yankees own the stadium even if they lease the land. First Amendment rights are accordingly limited.

Happy to see such a quick response. I think it's also good to remember that we can self-police this issue too. If you hear someone nearby yelling Puto, feel free to let them know that their actions are unacceptable (in whichever choice of terms and phrases you feel is appropriate). This is NY, there will always be someone close by that will happily help you put these idiots in their place verbally. Don't be violent, and if you don't feel comfortable then by all means get security and point the fools out. I think the more public shaming and fewer extra police/security we have around in the SG sections the better though.
