Yeah. When the tv deal is worth only $90M annually and you can’t sell tickets for at least 1.5 seasons that’s pretty force majurey to me.
I'm really curious to hear if there were specific covid related benchmarks that were specifically written into the CBA's force majeure clause. Something like specific national case numbers as of Dec 31, or lack of commitments from x number of relevant governors to allow fans etc.
If there were specific measurable's that were mutually agreed to, then this was an obvious move that you can't really hold against the owners.

The players wouldn't be allowed to renegotiate a bad deal, why should the owners expect a get-out-of-jail-free card?

While it's absolutely true that COVID is impacting MLS worse than other major American sports, this CBA was negotiated in February, renegotiated in June, and now the owners want a do-over. The players wouldn't be allowed to renegotiate a bad deal, why should the owners expect a get-out-of-jail-free card?
because the owners negotiated a fail safe in the force majure clause. They’re not ripping up the new agreement, they are abiding by it and had this contingency in place. I find it hard to believe this force majure clause wasn’t heavily negotiated and when drawn up by both parties & they were both very aware of the ramifications.

You have to assume that the MLSPA agreed to the Force Majeure would apply to a future superior force instead of the current one. There has to be a lot of “How did we not see this coming.” going on right now within the MLSPA.

I see multiple posts assuming the owners must have done this or the players that. It's all reasonable speculation. The bigger the deal, the more obvious the issue, means they must have addressed it. Right?

But after 30+ years experience in law, it is clear to me that sophisticated parties on the verge of a multi-million dollar deal have an almost limitless capacity to ignore pertinent and potentially catastrophic issues staring them in the face in order to close.

I think they actually make fun of MLS stuff quite a bit on their own site, though they unsurprisingly stay away from certain topics.

Yeah, I thought this one was good, hence the post. But mostly I wanted to post it bc of the atlanta crap lol

I agree with the professor by the way. If this account is accurate, then the league is perfectly entitled to invoke the clause, but that does not mean they are entitled to get their way in negotiations. It just means that everyone knew this might happen, and both decided to hope it would not, but here we are, and now they have to negotiate the hard part.

Curious to see whether Vanney can turn them around. I'd be optimistic if I were a Galaxy fan.

On the Ozil rumor, it's been kicking around since last year (here's the 2020 transfer tracker rumor report) but I guess it's just a question of where he moves to, not whether he'll move? The Athletic also had more detailed piece reporting on the connection to the coffee company thing last year. I think it's about more than concessions, I think he wants his foot in the door to growing his business after his playing career. I don't see it different than things that Beckham and Zlatan negotiated in terms of add-ons. On the field though, not sure how I would feel about that move if I were a DCU fan. Could he be great for them in MLS? Sure. Will he? Who knows. I haven't followed closely but even from my not paying much attention to other leagues I've seen articles about the tensions with Arsenal. He hasn't had a premier league or cup competition appearance in forever

Ozil has lots of quality IF and only if, he's motivated to play. In addition, he needs a supporting cast. If he doesn't have the attackers and covering midfield for him, he won't succeed. and last I remember, I don't think DC has any of that.

its weird they would rebrand, did they change ownership? its been impact de montreal or montreal impact the whole time saputo was owner.

No. Same ownership. I have no idea why a rebrand, but they've been teasing it for a bit. I don't know why they're rebranding, they really don't need one. I hate this rebrand trend, they're so boring half the time.
